Authorization For Use Of Military Force in Response to the 9/11 Attacks
(P.L. 107-40): Legislative History (PDF-6 pages, 44 KB)
January 2006
Source: Congressional Research Service
From cover page: "In response to the terrorist attacks against the
United States on September 11, 2001, the Congress passed legislation,
S.J.Res. 23, on September 14, 2001, authorizing the President to “use all
necessary and appropriate force against those nations, organizations, or
persons he determines planned, authorized, committed, or aided the terrorist
attacks that occurred on September 11, 2001, or harbored such organizations
or persons....” The President signed this legislation into law on September
18, 2001 (P.L. 107-40, 115 Stat. 224 (2001)). This report provides a
legislative history of this statute, the 'Authorization for Use of Military
Force' (AUMF), which, as Congress stated in its text, constitutes the
legislative authorization for the use of U.S. military force contemplated by
the War Powers Resolution. It also is the statute which the President and
his attorneys have subsequently cited as an authority for him to engage in
electronic surveillance against possible terrorists without obtaining
authorization of the special Court created by the Foreign Intelligence
Surveillance Act (FISA) of 1978, as amended. This report will only be
updated if events warrant."

From cover page: "This
memorandum lays out a general framework for analyzing the constitutional and
statutory issues raised by the NSA electronic surveillance activity. It then
outlines the legal framework regulating electronic surveillance by the
government, explores ambiguities in those statutes that could provide
exceptions for the NSA intelligence-gathering operation at issue, and
addresses the arguments that the President possesses inherent authority to
order the operations or that Congress has provided such authority."

Forward: "This monograph, by Dr. W. Andrew Terrill, addresses the
critical questions involved in understanding the background of Iraqi
national identity and the ways in which it may evolve in the future to
either the favor or detriment of the United States. The monograph also
provides particular attention to the issue of Iraqi sectarianism and the
emerging role of the Shi’ite Muslims, noting the power of an emerging
but fractionalized clergy. The result is a thoughtful and probing report
including policy recommendations for U.S. military and civilian
decisionmakers that helps to illuminate the complex subjects of Iraqi
nationalism and sectarianism and their relevance to the U.S. presence in
Iraq."

Abstract from web site: "In
Iraq, the United States is facing its most challenging nation-building
project since the 1940s. The authors draw lessons from seven case
studies—Germany, Japan, Somalia, Haiti, Bosnia, Kosovo, and
Afghanistan—then apply these to the Iraq case. The results suggest that
nation-building will be difficult but possible. Success will, however,
require investing sufficient financial, military, and political
resources—and time. "
